Many states now have mandatory disclosure laws as to who the agent is working for. Before you start looking for a home, decide on what level of representation you need.
Agents working for the seller: If an agent has a home listed, then that agent is an agent of the seller. The agent has promised to do their best for the seller, not you the buyer.
Agents just working for one party in a transaction: These are agents who only represent the buyer or the seller, never both at the same time.
Agents working as a disclosed Dual Agent in a transaction: Many states allow dual agency where the agent is working on behalf of the seller and the buyer. Representation for both parties is reduced as the agent cannot disclose any confidential information for either party to the other.
Agents working merely as a transaction broker. Agents who do not sign a buyer’s agency agreement with you can help you find a home, but they cannot give any advice on negotiating the contract. They have to remain neutral.
